What is listed or protected structure ?

Listed buildings or protected structures are buildings which the Local planning authority or county planning authority “consider to be of a special interest” from one of the following perspectives:

  • historical
  • archaeological
  • artistic
  • cultural
  • scientific, social or technical

The legislation relevant to protected structures & protected buildings is contained in the planning and development act – 2000 Part IV.

What are the legal considerations when purchasing a listed building or protected building?

Once a building or structure is on the RPS ( record of protected structures) any refurbishments or alterations to the building* or change in use will encounter a more stringent planning law & criteria from the local authority.  If a planned change in use or refurbishment of the building is foreseen our team can advise on what redevelopments (if any) will be permitted as works that are normally planning exempt may require planning permission on a protected or listed building. When buying a protected home or structure your solicitor should flag the protected status of the building during the conveyancing process.
